Is it possible to attach a tenant’s wages for rent owed?
Central
NJ Property Management - Take them to small claims court and get a judgment for the amount owed. If they do not pay you, go back to the judge and ask the court to attach their wages. Seek advice from a qualified attorney. We evicted a tenant and thought we would be owed quite a bit but to our
surprise the tenant filed for a stay last minute and the judge required them
to put approx. $1800 in escrow with the courts to even be heard for a stay.
Then again to our surprise the court only granted the tenant 2 days longer
and returned the money to us when done. After receiving the escrow money
and the security deposit we were still short but not by enough to go through
the paperwork and aggravation of chasing it. Our attorney said small claims
court would be the fist line of defense when money is owed.
When we evicted our tenant we had them sign a form giving us the
authorization to dispose of the items they left in the property due to the
eviction and that they had no intentions to return for these items therefor
holding us harmless. I checked with my attorney on this first and he said
if the tenant agrees and signs it we were good to go. Like yourself we had
set up a couple of times for the tenant to show and they never did. So how
I approached this was I contacted the tenant and explained that there would
be more cost to them if we had to move and store these items and if they
really didn't want the items back that we might as well just dispose of them
now vs. waiting 30 days. And the tenant did not want to have anymore costs
tacked on so they willingly signed the agreement. Check with your attorney
first. Hope this helps.
